CONTRACTUAL AGREEMENT / TUTORS AS INDEPENDENT CONTRACTORS
The independent contractor (tutor) agrees to:
1. Be punctual, neat, and clean, with special attention to groomed hands and nails.
2. Be professional, prepared, friendly, polite, and never curse in front of a client.
3. If the client wishes to pay by credit card or PayPal, ask him to give you an e-mail address to which we can send an invoice. (Client must have e-mail and Web access.) Otherwise, collect payment as a check made out to “Totally Tutored”. Charge $40 per hour in 15-minute increments, with a one-hour minimum.
4. Keep all scheduled appointments, promptly, with the client. The inability of the tutor to keep said appointment, for any reason, including sickness and emergencies, shall be conveyed to the client and office promptly. Upon becoming aware of the inability to keep said appointment you may reschedule or have the office send a substitute,
5. Discuss problems (scheduling, techniques, and materials) with the office immediately.
6. If upon arrival for a scheduled session, no one is home, wait 10 minutes, then leave a business card with a notation indicating the time and report this to the office immediately. The weekly log will be marked NO SHOW to show the status of the client. Consideration under the normal rate contract shall be redressed to half hour at the agreed upon rate.
7. ALWAYS call the TUTOR REPORT LINE, 818-501-5506 or 310-397-0999, or e-mail Tutors@TotallyTutored.com, within 24 hours of EACH session. The tutor log has instructions on what to report. Failure to do so will be considered a breach of contract. Two such breaches shall result in the contract summarily being terminated. Initial _____________

9. Covenant Not To Compete: The independent contractor will be disclosed proprietary information regarding the company (Totally Tutored), as well as information about clients.
The tutor may work outside of Totally Tutored but, for a period of one year following the term of work as an independent contractor with Totally Tutored, the independent contractor agrees that he/she shall not complete with Totally Tutored, or Shawn Wilson and/or Anne Wilson and/or Myrna Perks, directly or indirectly, in offering tutoring to any Totally Tutored client, or clients referred by a Totally Tutored client.
Independent contractor agrees that he/she will not, directly or
indirectly, disclose, communicate, divulge or furnish to, use
for the benefit of himself/herself or and other person, firm or
corporation, the information, ideas or processes of the services
offered through Totally Tutored.
If the tutor directly, or indirectly, solicits the business of
the tutoree, the tutor hereby agrees to reimburse Totally Tutored
the fixed rate of $25 per hour for all tutoring performed for
a period not to exceed one year. Any legal action that results
from enforcement of this contract, and all reasonable legal and
court costs shall be paid by the losing party.
